Terms of Use
These Terms of Use ("Terms") govern your use of the Wayly application. Wayly is developed and operated by Andrii, an individual developer based in Ukraine. By downloading, accessing or using Wayly, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility (age 13+)
You must be at least 13 years old to use Wayly. If you are under the age of majority where you live, you may use Wayly only with the involvement of a parent or guardian who agrees to these Terms.
2. The service
Wayly lets you record outdoor activities, reveal a personal "fog of war" map, plan routes, sync routes and activities with compatible watches and bike computers, and earn levels, collectibles and territory. Features may change, improve or be discontinued over time.
3. Your account
You are responsible for your account credentials and for activity under your account. Provide accurate information and keep it up to date. Notify us at wayly.contact@gmail.com if you suspect unauthorised use.
4. Subscriptions, pricing and billing
Wayly offers a free tier and an optional Wayly Pro upgrade. Current plans:

- Prices are shown in the app and may vary by region and currency. Local taxes may apply. We may change prices; changes do not affect a subscription period you have already paid for.
- Billing is handled by Apple (App Store) or Google (Google Play), not by us. We do not receive or store your payment details.
- Free trial: the 1-month free trial on the Yearly plan automatically converts to a paid subscription unless you cancel at least 24 hours before it ends.
- Auto-renewal: subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel any time in your App Store or Google Play account settings.
- Lifetime is a one-time purchase tied to your Apple ID or Google account; use "Restore purchases" to recover it on a new device.
- Refunds are handled by Apple or Google under their policies.
5. Safety disclaimer
Wayly is for recreation, not for navigation-critical or emergency use. Your safety is your responsibility:
- Stay aware of your surroundings; do not use the app while it is unsafe to do so (for example, do not look at your phone while crossing roads or on difficult terrain).
- Outdoor activity carries inherent risks. Assess your own fitness, the weather, the terrain and local conditions before setting out.
- Maps, routes and location data may be inaccurate or incomplete. Do not rely on Wayly as your only means of navigation, and always carry appropriate equipment.
- Wayly is not an emergency or medical service.
You use Wayly and take part in any activity at your own risk.
6. Acceptable use
You agree not to:
- Break the law or infringe others' rights while using the app.
- Interfere with, disrupt, reverse-engineer or attempt to gain unauthorised access to the app or its systems.
- Upload unlawful, harmful or infringing content, or impersonate others.
- Use the app to harass, endanger or track other people without consent.
We may suspend or terminate accounts that violate these Terms.
7. Intellectual property
Wayly, including its name, design, code, graphics and content (excluding your own content and third-party map data), is owned by us and protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, resell or create derivative works from it.
8. Your content
You retain ownership of content you create (such as activities, routes, photos and profile details). You grant us a licence to host and process that content solely to operate the app and provide the service to you, as described in our Privacy Policy.
9. Third-party services
Wayly relies on third-party services including Mapbox (maps), Supabase (hosting), Apple and Google (billing and platform services), and, where you connect them, Strava, Garmin, Suunto or Coros. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
10. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy or uninterrupted availability, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits, or for injury or loss arising from your activities or from reliance on the app. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Termination
You may stop using Wayly and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required to protect the service or other users.
13. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict of law rules. Mandatory consumer-protection rights in your country of residence are not affected.
14. Changes to these Terms
We may update these Terms as the app evolves. We will change the version and effective date above, and where changes are significant we will notify you in the app. Continued use after an update means you accept the revised Terms.
